State v. Farrell - No. 20120338
Michael Farrell appeals a district court order entering a civil judgment of $400 for unpaid fines and fees.
In 1993, Farrell pled guilty to criminal trespass and was sentenced to pay $200 in fees and fines. On the same day, Farrell pled guilty to criminal mischief and was ordered to pay $1,101.88 in fines, restitution, and fees. In 1994, the district court issued a bench warrant for Farrell ordering him to appear and pay $1,351.88 in unpaid fines and costs.
In 2012, Farrell sent a letter to the district court requesting a final disposition on any and all charges. The warrant for Farrell's arrest was withdrawn, and a civil judgment totaling $400 was entered by the district court.
On appeal, Farrell argues his rights were violated under the Interstate Agreement on Detainers Act because he was not brought to court to be sentenced or informed of his charge. Farrell seeks dismissal of his criminal trespass and criminal mischief charges and compensation of $500 per week beginning in July 2012.
