On September 14, 2012, Petitioner, Steven Zaiser, as Chairman of the Sponsoring Committee for the Statutory Initiative Relating to the North Dakota Medical Marijuana Act, filed an Application for Writ of Injunction under Original Jurisdiction, requesting this Court exercise its original jurisdiction and "issue an order instructing the Secretary of State to place the initiated measure on the November 6, 2012, general election ballot and issue an immediate injunction preventing the Secretary of State from approving or printing any ballots until a ruling from this Court is made." On September 17, 2012, Respondent, Alvin A. Jaeger, Secretary of State, filed a Brief in Opposition to Application for Writ of Injunction Under Original Jurisdiction. On September 18, 2012, Zaiser filed a Reply Brief in Support of Application for Writ of Injunction Under Original Jurisdiction. The Court considered the matter, and
IT IS HEREBY ORDERED, that relief requested is DENIED. A written opinion regarding the denial of the Application for Writ of Injunction under Original Jurisdiction will be filed at a later date.
The Supreme Court of the State of North Dakota convened this 19th day of September, 2012, with the Honorable Gerald W. VandeWalle, Chief Justice, the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, the Honorable Carol Ronning Kapsner, and the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order.
