I. Is the State Board of Higher Education's conduct in retiring the "Fighting Sioux" name and logo before November 30, 2010 a breach of the Settlement Agreement with the National Collegiate Athletic Association?
A. The intentions of the parties to this contract are clear.
B. The State Board of Higher Education's current interpretation and reliance on the phrase at "any time during the Approval Period is" contrary to the parties' intent at the time of entering into the Settlement Agreement.
