Appellee's Statement of the Issues:
The original issue on appeal was whether the District Court erred in affirming Child Support Enforcement's administrative action which placed a lien on Neil Toppen's personal property held in the possession of the North Dakota State Penitentiary. Neil Toppen is incarcerated. In his Appellant Brief, Neil Toppen [Toppen] states his argument at the district court level was wrong, but argues that the State failed to clearly express the type of lien levied against his property. Toppen raised a new issue on Appeal, arguing that the High Intensity Enforcement Unit of North Dakota Child Support Enforcement and the North Dakota State Penitentiary violated state law by entering into a negotiated or coordinated agreement to enforce an administrative action upon Toppen.
