Dianna L. Holm, Plaintiff and Appellant
Thomas J. Holm, Defendant and Appellee
|Appeal from:||East Central Judicial District, Cass County, Judge Steven L. Marquart, 09-2015-DM-01427|
|Nature of Action:||Divorce/Property Div./Alimony|
Appellant's Statement of the Issues:|
I. Whether the District Court erred in finding that the dividends received from the Building Fasteners of Fargo, Inc. stock ownership interest is additional compensation for the Defendant's employment?
II. Whether the district court erred in its failure to properly value the Building Fasteners of Fargo, Inc. stock ownership interest and to equitably divide that interest based on that valuation?
III. Whether the district court erred in finding that an equitable distribution of property would be an equal one even though the Respondent did not contribute to many of the costs of maintaining the marital home and marital debts after he moved out of the home?
Appellee's Statement of the Issues:
1. The trial court's detailed analysis of Thomas' employment contract, stock and dividends is supported by the evidence and not clearly erroneous.
2. The trial court's award of closely-held company stock to Thomas was not clearly erroneous and was supported by the evidence and testimony received.
3. The trial court's determination of equitable assets and distribution was not clearly erroneous.
