The District Court Abused its discretion through misapplication of the law, when considering Mr. Rath's Demand for Change Judge for the Child Support Modification request pursuant N.D.C.C 29-15-22(3)
The District Court abused its discretion in denying Kayla's contempt of a very clear and unambiguous provision of the divorce Judgment by unreasonably giving Kayla control of financial related information on the part of Mr. Rath; and Ignoring Kayla's refusal to disclose insurance information to Mr. Rath upon request.
Appellee's Statement of the Issues:
I. Whether the trial court erred when it denied Mr. Rath's demands for a change of judge?
II. Whether a court violates the separation of powers if it mandates that the child support guidelines include a deduction for an expense not already considered by the guideline provisions?
III. Whether the trial court abused its discretion when it denied Mr. Rath's motion for an order to show cause against Ms. Jones?
