1. Whether the failure of the North Dakota Department of Human Services (DHS) to issue a decision within seventy-five days rendered its decision "not in accordance with the law" under N.D.C.C. 28-32-46(1).
2. Whether DHS properly determined that it was entitled to recoup overpayments from Sanford.
Appellee's Statement of the Issues:
 Whether the District Court erred in finding the North Dakota Department of Human Services repeatedly failed to abide by the mandatory seventy-five day deadline to issue a final administrative decision under N.D.C.C. 50-24.1-24(5), and whether these unjustified and systemic failures rendered the Department's Order not in accordance with the law.
 If the District Court erred, whether consideration of the twenty-nine appeals concerning thirty-three claims of overpayment should be remanded back to the District Court for consideration by the district court.
