The Executive Committee of the Judicial Conference met on September 29, 2010. Chair Geiger
call the meeting to order at 8:02 a.m.
Justice Crothers moved to approve the minutes of the last meeting. Justice Kapsner seconded the
motion. The motion carried and the minutes were approved.
The Committee was advised that three members of the Judicial Branch Education Commission
were eligible for reappointment to the Commission. The members are Justice Mary Muehlen
Maring, Judge Sonna Anderson, and Dean of the University of North Dakota Law School,
Kathryn Rand. Judge McCullough moved to reappoint the three members to the Commission.
Justice Crothers seconded the motion. The motioned carried. Chair Geiger will send letters of
reappointment to all three members.
Chair Geiger advised the Committee of the need to finalize the date, location and agenda for the
November Judicial Conference and approve an agenda for the Business Meeting. The proposed
dates for the conference are November 22-23, 2010, at the Radisson Hotel in Bismarck, which
includes the proposed business meeting time of November 22, 2010, at 9:10 a.m. Judge
McCullough moved the adoption of the proposed conference date, location and agenda, including
the agenda for the business meeting. Justice Crothers seconded the motion.
Discussion ensued on when retiring members of the Judicial Conference should be recognized by
their peers. It was decided that they should be recognized at the November conference as they
end their service rather than waiting until the following year. Justice Crothers moved to include
the decision on recognition of retirees in the preceding motion to adopt the conference agenda.
Justice Kapsner seconded the motion. The motion carried.
Discussion then turned to the proposed agenda of the business meeting and the recognition of
deceased members of the Judicial Conference. It was decided that past members should be
recognized by resolution regardless of the length of time that has passed since their judgeship
ended. Judge McCullough moved to approve the proposed business meeting agenda and to
include recognition of all four deceased judges as part of the business meeting. Justice Crothers
seconded the motion. The motion carried.
Chair Geiger called for a vote on the motion to approve the Judicial Conference date, agenda and
location. The motion carried. A copy of the agenda for the conference and the business meeting
as adopted is attached.
The Director of Education and Communication was advised that minor adjustments to the
conference agenda and the business meeting could be made without further approval of the
Committee.
Chair Geiger then called for any additional business. There being no additional business, the
meeting was adjourned at 8:17 a.m.
