MINUTES OF MEETING
Joint Committee of the Judicial Council and the State Bar Association for the Adoption of Rules of Criminal Procedure
September 21, 1967
Judge Erickstad, Chairman, called the meeting to order in the hearing room of the North Dakota Supreme Court at 9:00 a.m. Present were: Judge Ralph J. Erickstad; Judge Eugene A. Burdick; Judge Roy A. Ilvedson; Judge Norbert J. Muggli; Judge Kirk Smith; Mr. John Shaft; Mr. Theodore Kellogg; Mr. Robert Vogel; Mr. John A. Graham (Secretary pro tem).
Mr. Graham discussed the method used in annotating the Federal Rules of Criminal Procedure for use by the committee as a study guide.
Judge Smith suggested that a statement of the aims and scope of the committee be prepared prior to the next meeting of the committee, and Chairman Erickstad appointed Judge Smith to accomplish this task.
Mr. Kellogg stated that he had appointed a committee consisting of members of the State Bar Association to work in cooperation with this committee, said appointees being William Murray, Robert Vogel, and James Schlosser.
Judge Burdick expressed the view that the Bar Association Committee members act only in an advisory capacity to the Judicial Council Committee. After a review of the Judicial Council resolution creating the committee, it was decided to seek a clarification at the next Judicial Council meeting of the meaning of the resolution. Judge Ilvedson was appointed to secure this clarification.
The Chairman requested that the members of the committee come to the next meeting prepared to discuss Rules 1-5.
Judge Muggli moved that the next meeting be held in Bismarck on Friday, November 17, 1967, at 10:00 a.m., with the understanding that the committee would meet on Saturday if it should be necessary. The motion was seconded by Judge Smith and carried unanimously.
Judge Ilvedson moved adjournment, and the meeting was adjourned at 11:00 a.m.
