On April 2, 2003, the Judicial Planning Committee's Planning Recommendations for the administrative reorganization of the judicial system were filed. A Judicial Reorganization Implementation Plan was also received by the Court.
A Notice of Comment dated April 2, 2003, was published on the Court's web page, and comments were accepted through July 2003.
The Court after reviewing the recommendations and comments, is considering amendments to North Dakota Supreme Court Administrative Rules 2 and 22, and a proposed North Dakota Supreme Court Administrative Rule 6.1, all to become effective August 1, 2004. The rules, as proposed, are attached.
The Court is further considering requesting the 2005 Legislative Assembly to amend Section 27-05-05, N.D.C.C., regarding the selection of presiding judges in administrative units. Should such legislation be enacted, the Court will then consider further amending North Dakota Supreme Court Administrative Rule 2 to be consistent with the enacted legislation. The anticipated amendments to North Dakota Supreme Court Administrative Rule 2 following the Legislative Assembly are attached.
ORDERED, any person wishing to comment on the proposed rule amendments may do so in writing by Monday, February 2, 2004. The Supreme Court of the State of North Dakota convened January 2, 2004, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable William A. Neumann, and the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, and the Honorable Carol Ronning Kapsner, Justices, directing the Clerk of the Supreme Court to enter the above order.
