Proposed Amendments to North Dakota Rules of Professional Conduct 5.5 and 8.5 and Admission to Practice Rule 3 relating to Multijurisdictional Practice
On September 10, 2004, the Joint Committee on Attorney Standards filed proposed amendments to North Dakota Rules of Professional Conduct 5.5 (Unauthorized Practice of Law) and 8.5 (Jurisdiction), and North Dakota Admission to Practice Rule 3 (Limited Admission of Nonresident Attorneys) along with a Report on its work relating to Multijurisdictional Practice. Notice was provided under Section 7, N.D.R.Proc.R., and a hearing was held on the proposed amendments on November 9, 2004, at 10:45 a.m. Any written comments received were also submitted to the Court. The Court considered the matter, and
ORDERED, proposed amendments to N.D.R. Prof. Conduct 5.5 and 8.5, and N.D. Admission to Practice R. 3, with further amendments by the Court to N.D.R. Prof. Conduct 5.5, are ADOPTED, effective March 1, 2005.
FURTHER ORDERED, North Dakota Rule of Court 11.1 (Nonresident Attorneys Not Licensed in North Dakota) is superseded with the adoption of these amendments, effective March 1, 2005.
