In the Matter of the Judicial Vacancy in District Judgeship No. 5, with Chambers in Ellendale, North Dakota, Southeast Judicial District
By letter dated January 31, 2006, the Honorable Ronald E. Goodman, District Judge for the Southeast Judicial District, notified Governor John Hoeven that he is retiring as a District Judge effective August 1, 2006. On February 3, 2006, Governor Hoeven notified Chief Justice VandeWalle of Judge Goodman’s retirement. Judge Goodman’s retirement creates a vacancy under Section 27-05-02.1, N.D.C.C.
ORDERED, the Supreme Court will undertake a consultation with the attorneys and judges of the Southeast Judicial District under Administrative Rule 7.2. Any person wishing to comment on the vacancy may do so in writing. Written comments may be e-mailed to Penny Miller, Clerk of
the Supreme Court, at supclerkofcourt@ndcourts.gov, or addressed to 600 E. Boulevard Ave., Dept. 180, Bismarck, ND 58505-0530. A hearing will be held on the matter on Monday, March 27, 2006, at 2:45 p.m., in the Ralph J. Erickstad Courtroom of the Supreme Court, at the State Capitol in Bismarck, North Dakota. Time for personal appearances will be limited; therefore, written comments forwarded prior to the date of the hearing are strongly encouraged. Any person wishing to appear must notify Penny Miller, Clerk of the Supreme Court, at least three days prior to the scheduled hearing.
The Supreme Court of the State of North Dakota convened February 8, 2006, with the Honorable Gerald W. VandeWalle, Chief Justice, the Honorable Dale V. Sandstrom, the Honorable Carol Ronning Kapsner, and the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order. The Honorable Mary Muehlen Maring, being unavoidably absent, did not participate in this decision.
