ORDER OF ADOPTION

ORDERED, that proposed amendments to the Code of Mediation Ethics and the Code of Ethics
Enforcement Procedure, as further amended by this Court, are ADOPTED as amendments to
N.D.R.Ct. 8.9, and as Appendix A. Code of Mediation Ethics to N.D.R.Ct. 8.9, effective August 1,
2009.
The Supreme Court of the State of North Dakota convened July 22, 2009, with the Honorable
Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable
Mary Muehlen Maring, the Honorable Carol Ronning Kapsner, the Honorable Daniel J. Crothers,
Justices, directing the Clerk of the Supreme Court to enter the above order.

Proposed Code of Mediation Ethics and
On March 9, 2009, the Alternative Dispute Resolution Committee filed a request for a proposed
Code of Mediation Ethics and Code of Ethics Enforcement Procedure to provide standards of ethical
conduct to guide mediators who provide mediation services, to inform and protect consumers of
mediation services, and to ensure the integrity of the mediation process. A Notice of Comment was
distributed and published on the Supreme Court website on March 11, 2009. All comments received
were referred to the Court. The Court considered the matter, and
