On July 14, 2009, the Joint Procedure Committee filed a request for
proposed rule amendments to Rule 5 of the North Dakota Rules of Criminal Procedure. The Court considered the request, amended it and a
Notice of Comment was published on July 15, 2009. In light of the comments, a hearing was held October 21, 2009. The Court further considered the matter, and
ORDERED, that the proposed amendments, as further amended by this Court, are
ADOPTED, effective March 1, 2010. A
copy of the amended rule is attached.
The Supreme Court of the State of North Dakota convened December 2, 2009, with the
Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, the Honorable Carol Ronning Kapsner, the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order.
