Amendments to North Dakota Rules as Adopted

Proposed Amendments to the North Dakota Rules of Criminal Procedure, North Dakota Rules of Appellate Procedure, North Dakota Rules of Court, and North Dakota Supreme Court Administrative Rules

On July 31, 2009, the Joint Procedure Committee filed a request for proposed rule amendments to Rules 11 (Pleas), 32 (Sentence and Judgment), 43 (Defendant's Presence), 48 (Dismissal) of the North Dakota Rules of Criminal Procedure, Rule 24 (Supplemental Brief of Indigent Defendant) of the North Dakota Rules of Appellate Procedure, and Rules 1.1 (Scope), 4.2 (Notice to Interested Parties), and 8.12 (Notice in Action to Terminate Parental Rights) of the North Dakota Rules of Court. On October 21, 2009, a hearing was held for further comment on the proposed rules. The Court considered the matter, and

ORDERED, that the proposed amendments to N.D.R.Crim.P. 11, N.D.Crim.P. 32,N.D.R.Crim.P. 43, N.D.R.Crim.P. 48, N.D.R.App.P. 24, N.D.R.Ct. 1.1, N.D.R.Ct. 4.2, N.D.R.Ct. 8.12, as further amended by the Court, and amendments to N.D.R.Ct. 6.9 and the Appendix to N.D.Sup.Ct.Admin.R. 9, are ADOPTED effective March 1, 2010. A copy of the rules, as amended by the Court, is attached.

The Supreme Court of the State of North Dakota convened December 2, 2009, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, the Honorable Carol Ronning Kapsner, the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order.
