The Executive Committee of the Judicial Conference met on May 16, 2013. Chair Kapsner
called the meeting to order at 8:15 a.m.
Chair Kapsner notified the members that the Court has accepted the report of the Judicial
Planning Commission. This is included as an agenda item for the Judicial Conference in June.
Judge Geiger moved that the minutes of the February 7, 2013 meeting be approved.
Seconded by Judge McCullough. Motion carried.
The Committee was advised that there is a need to appoint two judges to the Pattern Jury
Instruction Commission. Judge Gary Lee’s term will expire on June 30, 2013. He currently
chairs the Commission, is eligible for reappointment, and has expressed interest in remaining on
the committee. Judge Zane Anderson’s term will also expire on June 30, 2013. Judge Anderson
is not eligible for reappointment due to term limits. Justice Kapsner reported that two people
have expressed interest in being appointed to the Commission: Judge Gail Hagerty and Judge
John Irby. The appointments are made by the Chair of the Judicial Conference after consultation
with the Executive Committee. There was general discussion that because Judge Hagerty has
recently served on the Commission and Judge Irby has never been a member of the committee,
the opportunity for service should go to him.
Judge Geiger moved to recommend the appointment of Judge Irby to the Pattern Jury
Instruction Commission. Seconded by Judge McCullough. Motion Carried.
At this point, Judge Lee left the meeting. After commenting on the good work Judge Lee has
done as chair of the Commission, Judge Geiger moved to recommend the re-appointment of
Judge Lee to the Pattern Jury Instruction Commission. Seconded by Judge McCullough.
There being no further business to come before the committee, the chair adjourned the meeting
at 8:22 a.m.
