The Executive Committee of the Judicial Conference met on September 26, 2012. Chair
Kapsner called the meeting to order at 8:02 a.m.
Judge McCullough moved to approve the minutes of the last meeting. Judge Geiger seconded
the motion. The motion carried and the minutes were approved.
The Chair recognized Lee Ann Barnhardt, Director of Education. Ms. Barnhardt reviewed the
proposed conference agenda for the November conference. She explained that there was
difficulty in obtaining a suitable location due to the number of fall conferences in Bismarck
during the time frame of late October through mid-November. Judge Geiger moved to adopt the
date, location and agenda as presented. Justice Sandstrom seconded the motion. The motion
carried. The conference will be held November 19-20, 2012, at the Seven Seas, in Mandan. The
agenda will follow the attached schedule.
Chair Kapsner recognized Sally Holewa. Ms. Holewa reviewed the proposed agenda for the
business meeting. As of today’s date, there are no memorial resolutions necessary. Chair
Kapsner said she will contact Judge Sonna Anderson for a report from the Committee on
Legislation. Judge McCullough said that Jim Ganje is currently drafting two pieces of legislation
at the request of the Administrative Council. One is to abolish all the add-on fees that are
attached to sentences and replace them with a single fee. The other is to make bail the property
of the defendant and allow the court to take bail to apply to any outstanding monies owed to the
court. These two bills will be brought before the Judicial Conference for review and discussion.
Justice Sandstrom suggested that the results of the weighted caseload studies be discussed at the
business meeting. Chair Kapsner said that she would add the Supreme Court budget proposal on
additional resources as an item on the business agenda. Chair Kapsner said that under Item #3,
Other Business, she would ask Justice Crothers to provide an update on the activities of the Court
Services Administration Committee in regard to services for self-represented litigants. Justice
Sandstrom moved the adoption of the business meeting agenda as discussed. Judge McCullough
seconded the motion. The motion carried. The business meeting will be held on November 19,
2012. The agenda is included on the attached schedule.
Staff was directed to circulate the agenda for the business meeting and the Administrative
Council bill drafts to all members of the Judicial Conference at least one week before the
conference.
In other business, Chair Kapsner explained that although the appointment of a public member to
the Disciplinary Board is not a matter for the Executive Committee, she is interested in getting
suggestions for a replacement appointment from the members. Justice Sandstrom suggested that
Nadine Lehr, who currently serves as the Pastor of Lord of Life church in Bismarck, would be a
good addition to the Board. No other names were advanced.
The meeting was adjourned at 8:24 a.m.
