RE: Rule 49, N.D.R.App.P.; Effective Date; Statutes and Rules Superseded
The proposed amendments to Rule 49 generally track the form and style of the 1998 amendments to the federal appellate rules--the language and organization of the rule are amended to make the rule more easily understood and to make style and terminology consistent throughout the rules.
In addition to the form and style amendments, references to amendments or additions to the rules have been added to clarify that there may be effective dates subsequent to March 1, 1973, and that on the effective date of an amendment or addition, all statutes or rules in conflict with the amendment or addition are superseded.
