The Supreme Court adopted Rule 52 effective May 1, 2005. The rule combines features from the three ITV pilot project rules to create a uniform ITV rule that will have statewide application. The ITV pilot project rules will be repealed May 1 when Rule 52 takes effect.
The Court has asked the Committee to review and comment on the rule. Once the Committee completes its task, the Court may seek additional comments or hold a hearing on the rule. The Court made the rule effective May 1 so the courts that are ready to use ITV, in particular Fargo Municipal Court, will have guidelines for their proceedings.
The court sought comments on the rule from presiding judges in districts where ITV has been used. These comments are attached. The Court did not make any changes to the Rule 52 proposal based on these comments, in part because it wanted to give the Committee a chance to discuss the comments.
