Rule 12.4 Post-Judgment Collection Actions
(a) Once the Judgment is entered, any further proceedings in which the assistance of the Court is sought must be done only on the basis of pleadings properly served upon all parties in accordance with NDRCivP Rule 4 or a particular statute providing for service in special cases.
(b) No post-judgment action will be considered by the district court until the judgment creditor exhausts all remedies provided under NDCC 28-21. When those remedies are exhausted, the judgment creditor may undertake discovery under NDRCivP Rule 69 "in aid of execution." The district court has the discretion to require the judgment creditor to exhaust all remedies before any proceeding is held under NDCC 28-25.
