RE:Appendix F, N.D.R.Ct.; Alternative Dispute Resolution Statement Form
The Committee has received a request from Judge Hagerty to amend N.D.R.Ct. Appendix F. Judge Hagerty suggests that new material be added to the N.D.R.Ct. 8.8 Alternative Dispute Resolution Statement form regarding scheduling. Under N.D.R.Ct. 8.8, parties to a civil suit are required to file an Alternative Dispute Resolution Statement indicating their willingness to participate in ADR. The purpose of the proposed amendments to the Alternative Dispute Resolution Statement form is to require the parties also to provide information about when key events in the progress of the case should take place so that the court will have adequate information to use in preparing a scheduling order.
The proposed amendments to N.D.R.Ct. Appendix F (the Alternative Dispute Resolution Statement form) are included in the agenda materials. The committee may wish to consider whether any rules should be amended to include a requirement for scheduling information to be provided with the Alternative Dispute Resolution Statement.
