Attached are proposed amendments to Rule 17. The amendments for the most part are form and style amendments in the spirit of the December 2002 federal criminal rule amendments.
At lines 51-76 there is a proposed substantial deletion of material relating to old-fashioned methods of service. The part of Rule 17 to be removed was based on part of N.D.R.Civ.P. 45 as it existed when criminal rules were promulgated. The Committee, however, removed this material when it rewrote N.D.R.Civ.P. 45 in 1993-1994, so removing this material from Rule 17 now may be appropriate.
