RE: Rule 43, N.D.R.Crim.P., Presence of the Defendant
Attached are proposed amendments to Rule 43. The amendments are form and style amendments in the spirit of the December 2002 federal criminal rule amendments and are based on the amendments to Fed.R.Crim.P. 43.
This rule was recently amended to include language referring to interactive television. This amendment is retained at lines 11-12 of the proposal.
Under the proposed amendments, the organization of the rule is changed. The form and language changes are intended to be stylistic only.
