RE: Rule 59, N.D.R.Crim.P., Effective Date--Statutes Superseded
Attached are proposed amendments to Rule 59. The amendments are form and style amendments in the spirit of the December 2002 federal criminal rule.
Rule 59 is not based on the federal rule, which has been deleted. Instead it is based on N.D.R.App.P. 49, which the Committee revised as part of the appellate rule review. It is intended to give guidance on how rule amendments apply to pending cases.
