RE: Rule changes to facilitate unbundled legal services
The Committee considered rule changes intended to facilitate unbundled legal services at its October meeting. After making a substantial number of amendments to the rule proposals, the Committee referred the rule proposals back to staff for review and editing.
The majority of the Committee's amendments were made to Rule 11(e), a new subdivision dealing with limited representation by attorneys. The main changes the Committee made were adopting the term "limited representation" rather than "limited appearance" and changing references to "service" rather than to "filing."
Staff has redrafted Rule 11(e) according to the preferences expressed by the Committee. Staff also divided Rule 11(e) into three paragraphs to improve organization. The revised Rule 11 proposal is attached.
Likewise, staff revised the Rule 5 and Rule 11.2 proposals to incorporate the terminology preferred by the Committee. Revised Rule 5 and Rule 11.2 proposals are attached.
