RE: Rule 707, N.D.R.Ev., Analytical Report Admission; Confrontation
The Supreme Court adopted a new evidence rule in response to the United States
Supreme Court’s decision in Melendez-Diaz v. Massachusetts, 129 S.Ct. 2527 (2009). It
becomes effective February 1, 2010, subject to a comment period. Anyone wishing to
comment on the proposed rule may do so in writing before Monday, March 1, 2010. Written
comments may be e-mailed to Penny Miller, Clerk of the Supreme Court, at
supclerkofcourt@ndcourts.gov, or addressed to 600 E. Boulevard Ave., Bismarck, ND
58505-0530.
A copy of the Order of Adoption and a copy of Rule 707 are attached.
