RE: Rule 65, N.D.R.Civ.P., Injunctions
The extensive rewrite of Rule 65 that the committee prepared took effect July 1, 2012. Committee member Larry Boschee has examined it and suggests that some amendments could be made to clarify that the rule applies to permanent injunctions in addition to temporary restraining orders and preliminary injunctions.
Mr. Boschee has outlined his proposed changes in an e-mail, copy attached. Staff has
prepared proposed amendments, attached, based on his suggestions. Also attached is a copy
of Fed.R.Civ.P. 65 for reference.
