RE: Change in Location of Rule 77(d), N.D.R.Civ.P.
The Committee has a request to transfer N.D.R.Civ.P. 77(d) to N.D.R.Civ.P. 58 for the purpose of making it easier to locate. Rule 58 governs entry of judgment, while Rule 77(d) governs notice of entry of judgment. Except for subdivision (d), Rule 77 refers to the district courts and clerks in general.
Rule 77 follows the format of Fed.R.Civ.P. 77. However, North Dakota's subdivision (d) is substantially different than the federal rule's subdivision (d).
Does the Committee want to transfer Rule 77(d) to a different location?
