RE: Petition to Amend N.D.R.Ct. 10.1
The Committee has a petition submitted by Judge Robert O. Wefald for amendment of N.D.R.Ct. 10.1. In the annual rules package currently pending before the Supreme Court, the Committee recommended amending N.D.R.Ct. 10.1, to deal, in part, with wireless communication devices. The Committee's deliberations on that recommendation are found at pages 17-18 of the January 2000 minutes. I have included in the materials the version of the rule currently pending hearing before the court and a draft of Judge Wefald's proposal incorporated into the version of N.D.R.Ct. 10.1 currently in effect. The materials also include Judge Wefald's petition and comments from Judges Erickson and McGuire.
