RE: N.D.R.Ct. 8.2; "Interim Orders in Domestic Relations Cases"
The Committee has a request for amendment of N.D.R.Ct. 8.2 from Judge Geiger. Currently, Rule 8.2 provides for interim support payments to "be paid to and through the clerk of the district court." Section 14-09-08.1(1), N.D.C.C., provides for child support payments to "be paid to the state disbursement unit for remittance to the obligee." See also N.D.C.C. § 14-09-26. These materials include a proposed amendment that conforms Rule 8.2 with the statutory language of N.D.C.C. § 14-09-08.1(1).
Additionally, in the annual rules package currently pending before the Supreme Court, the Committee also recommended amending N.D.R.Ct. 8.2. The Committee deliberations on that recommendation are found at pages 19-21 of the January 2000 minutes.
