Re: North Dakota Rules of Appellate Procedure
RULE 27, N.D.R.App.P.
In general, the amendments make motion practice in the Supreme Court more cumbersome and difficult and do not address any current procedural problems or simplify the current practice. The amendments also unnecessarily delay the otherwise speedy resolution of motions.
The format requirements are in direct conflict with the format requirements for other documents filed in the Supreme Court, i.e. briefs.
A member of the Clerk's Office will be present at the Joint Procedure Committee Meeting on Friday, September 29, 2000, to discuss in greater detail our concerns with these amendments.
