RE: Rule 45, N.D.R.Civ.P., Subpoena
Committee member Larry Boschee sent an email to the Chair with a request to amend Rule 45. Mr. Boschee requests that Rule 45(a)(3) be amended to allow a North Dakota district court to issue a subpoena on a letter of request from a tribal court of a federally-recognized tribe. Staff has prepared amendments to the rule on lines 29, 31-32, and 34.
The proposed amendments to Rule 45, and copies of Mr. Boschee's email, Michigan Court Rule 2.615, and N.D.R.Ct. 7.2 are attached.
