RE: Rule 27, N.D.R.Civ.P., Depositions Before Action or Pending Appeal
Fed.R.Civ.P. 27 has been modified, effective Dec. 1, 2005. Paragraph (a)(2) of the rule was rewritten to eliminate an outdated cross-reference and to conform to current federal rule style conventions.
A package of form and style amendments to the Federal Rules of Civil Procedure has been prepared and distributed for comment. Final adoption is expected in December 2007. The revision to Fed.R.Civ.P. 27 seems to be a preview of the coming amendments.
Staff has prepared amendments to N.D.R.Civ.P. 27 that are consistent with the federal amendments. A rule draft containing the proposed amendments is attached.
