The Joint Procedure Committee filed proposed amendments to North Dakota Rules of Criminal Procedure 11, 32, 43 and 48; North Dakota Rules of Appellate Procedure 24; and North Dakota Rules of Court 1.1, 4.2, and 8.12. A synopsis is attached. A complete copy of the proposed Amendments may be obtained from the Clerk of the Supreme Court.
ORDERED, that a hearing be held on the proposed amendments, Wednesday, October 21, 2009, at 2:45 p.m., in the Ralph J. Erickstad Courtroom of the Supreme Court, at the State Capitol in Bismarck, North Dakota. Time for personal appearances will be limited. Any person wishing to appear must notify Penny Miller, Clerk of the Supreme Court, at least three days prior to the scheduled hearing. Any person wishing to comment on the proposed amendments may do so in writing prior to the hearing. The Supreme Court of the State of North Dakota convened this 12th day of August, 2009, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, and the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order. The Honorable Carol Ronning Kapsner, being unavoidably absent, did not particpate in this decision.
