SYNOPSIS OF PROPOSED AMENDMENTS
A. North Dakota Rules of Criminal Procedure
An amendment to Rule 11 is proposed creating a new subdivision (d) by transferring the plea withdrawal procedure from Rule 32 and clarifying the language of the withdrawal provision.
Rule 32 - Sentence and Judgment
An amendment to Rule 32 is proposed deleting subdivision (d) on plea withdrawal and transferring the provision to Rule 11.
Rule 43 - Defendant's Presence
An amendment to Rule 43 is proposed creating a new paragraph (a)(3) on the procedure to be followed when the jury requests information on a point of law or testimony.
An amendment to Rule 48 is proposed clarifying when a court may dismiss a criminal proceeding and including a reference to the uniform complaint and summons.
B. North Dakota Rules of Appellate Procedure
Rule 24 - Supplemental Brief of Indigent Defendant
A new rule is proposed providing a procedure for indigent defendants to follow when they desire to make points on appeal in addition to those included in the brief filed by counsel.
C. North Dakota Rules of Court
An amendment to Rule 1.1 is proposed including juvenile cases within the scope of the Rules of Court.
Rule 4.2 - Notice to Interested Parties
Deletion of Rule 4.2 is proposed.
Rule 8.12 - Notice in Action to Terminate Parental Rights
A new rule is proposed providing a procedure to give parents facing termination of parental rights notice of their right to counsel.
