FEES AND EXPENSES FOR COURT REPORTERS PREPARATION OF TRANSCRIPTS
FEES
A. Fees.
1. Effective July 1, 1997, fees for production of transcripts by court reporters which are related to the business of the court will be paid to the state unless the cost of production of the transcript is the responsibility of the North Dakota judiciary. If the judiciary is responsible for the cost of production, no fee will be assessed.
The business of the court is defined as:
a. A transcript prepared as a result of filing a notice of appeal under Rule 10, NDRAppP.
b. A transcript prepared as a result of a party indicating that the transcript may be used for purposes of appeal.
c. A transcript ordered by a judge or prepared at the direction of the judge.
d. A transcript prepared to support a motion for a new trial under Rule 59, NDRCivP, or Rule 33, NDRCrimP.
e. A transcript prepared under the Post Conviction Relief Act (Chapter 29-32.1, NDCC).
f. A sentencing transcript prepared under Section 12-55-31, NDCC.
g. Any other transcript where the judiciary incurs the expense of the transcript.
2. If the cost of production of the transcript is not the responsibility of the judiciary, parties will pay a per page fee of $1.90 for the original, 35 for the first copy and 15 for each additional copy to the state if the transcript is within the definition of subsection 1 of this policy.
1. For the preparation of a transcript from shorthand notes, the court reporter is entitled to receive compensation of $1.90 for the original, 35 for the first copy, and 15 for each additional copy.
2. Sentencing Transcript.
Court reporters will not receive per page compensation for preparation of sentencing transcripts prepared under Section 12-55-31, NDCC.
3. From Audio or Video Tape.
Court reporters will not receive per page compensation for preparation of transcripts from audio or videotape.
EXPENSES
A. Expenses Associated With Recording the Proceeding.
The state will pay for expenses associated with recording the proceedings and maintenance of stenographic equipment owned by the state. Until otherwise determined by the state court administrator, the reporter will provide his or her own stenographic equipment.
B. Expenses for Producing a Transcript.
The reporter will be responsible for costs associated with producing a transcript if the reporter is entitled to additional compensation for the transcript, including paper, copying, binding, etc. The state will pay for associated expenses if the transcript is prepared at the order of a judge and the reporter is not entitled to additional compensation.
C. Computer-CAT System.
The state court administrator may approve the purchase of computers, software, stenowriters, and other CAT related expenditures upon approval of a statewide CAT implementation plan.
