Review of Minutes
The minutes of the February 29, 2008, meeting were approved.
Best Practices Manual
A draft of the updated Best Practices Manual was distributed.
Proposed Rules
Rule 10 Discovery
Typos on line 19 and 22.
Line 25 change “guilty or punishment” to “adjudication or disposition”.
Add notations on line 51.
Rule 11 Subpoena
Mike Hagburg says this is all new; criminal rule adopted to Juvenile Civil Rule #45.
Add provision for giving other parties notice and person can object to subpoena.
Rule 12 Lay GAL
Discussion on the education qualifications. Should education be similar to Rule 8.6 Custody
Investigator?
Check to see how many current lay GAL do not have bachelors degree.
Judge Kleven states that 8.6 (b)(5) language should be part of this rule.
Mike Hagburg to draft education requirements consistent with Rule 8.6:
Lines 39 and 40: add “copies provided to parties” (parties are defined in Rule 2).
Lines 46 through 58: take out all of “d”; replace with language from 8.6 (d) Court Proceedings.
Review Board - make up of review board: 1 Judicial officer; 1 defense attorney; 1 state’s attorney;
1 social service representative; 1 juvenile court officer; 1 lay GAL; plus chair; staffed by one
program staff and 1 from State Court Administrator’s Office. Chair appointed at large by chief
justice; all members appointed by chief justice.
Mr. Hagburg will re-write section “e”.
Section “f” change “lay GAL office” to “State Court Administrative Office”.
Rule 13 Professional Hearing
Accept as written.
Rule 14 Modification and Vacation of Orders
Accept as written.
Rule 15 Notice of Alibi Defense

Further Discussion
Kim Hegvik would like additional rule on pre-trial motions and continuances similar to criminal
rule. Mike will draft.
Next meeting is scheduled for August 8, 2008, in Grand Forks, from 10 a.m. to 2 p.m.
