The Executive Committee of the Judicial Conference met on October 7, 2009. Chair Geiger call
the meeting to order at 8:00 a.m.
Justice Crothers made a motion to approve the minutes of the last meeting. It was seconded by
Judge Herman. The motion carried and the minutes were approved.
The Committee was advised that three members of the Judicial Branch Education Commission
were eligible for reappointment to the Commission. The members are Judge David Reich, Judge
Steven McCullough, and court recorder Jean Lindvig. Justice Kapsner made a motion to
reappoint the three members to the Commission. The motion was seconded by Justice Crothers.
The motioned carried. Judge McCullough abstained.
Judge Geiger advised the committee of the need to finalize the date and schedule for the
November Judicial Conference and approve an agenda for the Business Meeting.
Lee Ann Barnhardt, Director of Education and Communication, had distributed a draft agenda
prior to the Committee meeting. The proposed dates are November 23-24, 2009 at the Radisson
Hotel in Bismarck, with the Conference convening at 9 a.m. One and one-half hours was
proposed for the Business Meeting. Judge McCullough made a motion to adopt the proposed
date and business meeting schedule. The motion was seconded by Judge Herman. The motion
carried.
The adopted schedule is as follows: 9 a.m. to 10:30 a.m. Judicial Conference Business Meeting Memorial Resolutions Committee Reports Odyssey Case Management Update Election of Chief Justice of North Dakota Supreme Court Other Business
Justice Kapsner requested that a brief overview of the Commission to Study Racial and Ethnic
Bias in the Courts be included as part of the afternoon education session on bias.
Judge Geiger asked that the minutes also reflect that Judge Simonson and Judge Webb have been
reappointed to the Pattern Jury Instruction Commission.
Judge McCullough made a motion to adjourn the meeting. The motion carried and the meeting
was adjourned at 8:15 a.m.
