The Executive Committee of the Judicial Conference met on September 27, 2013. Chair McCullough called the meeting to order at 8:15 a.m.
Chair McCullough opened the meeting with a request that the agenda be amended to include discussion on nominations to the Judicial Education Commission.
Judge Romanick moved that the agenda be amended to add discussion of nominations for the Judicial Education Commission. Seconded by Justice Kapsner. The motion carried and the agenda was amended.
Justice Kapsner moved that the minutes of the May 16, 2013 meeting be approved. Seconded by Justice Sandstrom. Motion carried.
Judge Romanick moved that the proposed date, location and agenda for the Judicial Conference be approved. Seconded by Justice Kapsner. The motion carried and the Judicial Conference was set for November 25-26, 2013, at the Radisson Hotel, in Bismarck, North Dakota, with no changes to the proposed agenda.
Justice Sandstrom moved that the proposed date, location and agenda for the business meeting of the Judicial Conference be approved. Seconded by Judge Romanick. Motion carried. It was decided that an email will be sent to all members of the Judicial Conference a week before the conference soliciting suggestions for discussion on any current statutes and any proposed legislative changes that the Conference should consider at the business meeting.
Lee Ann Barnhardt, Director of Education and Communication, who serves as staff to the Judicial Education Commission, informed the Committee that there will be three vacancies on the Education Commission in December. Justice Maring and Judge Sonna Anderson will have reached their term limits and will not be eligible for re-appointment. The term of Kathryn Rand, Dean of the North Dakota School of Law, will also expire in December, and she is eligible for re-appointment. Justice Kapsner suggested we ask the current chair of the Education Commission for recommendations. Justice Sandstrom suggested that an email be sent to all judges soliciting interest because the Chair may not be aware of everyone who may be interested in serving on the Commission. Chair McCullough said he would like to fill one of the vacancies with a justice. There was general agreement by the Committee that Dean Rand should be reappointed if she is willing to continue serving. The Executive Committee agreed to meet during the Judicial Conference in November to review the nominations and make appointments to the Education Commission.
The Executive Committee discussed honoring newly retired Judge Joel Medd and retiring member Justice Mary Muehlen Maring during the luncheon on November 25, 2013. It was decided that the honorees would be given the option of choosing the recognition gift they would like to receive.
There being no further business to come before the committee, the chair adjourned the meeting at 8:31a.m.
