Justice Maring called the meeting to order. A motion was made by Judge Reich to approve the August 9, 2013, minutes. The motion was seconded by DeNae Kautzmann, motion carried.
1. Conference Updates - Ms. Barnhardt updated the Commission on the progress of the following conferences.
A. The ICWA conference is scheduled February 19-21, 2014, at the Seven Seas in Mandan. This is sponsored by the Native American Training Institute.
B. The Spring Juvenile Court Conference is scheduled April 15-16, 2014, at the Ramkota Hotel in Bismarck. This conference will be offered twice a year and held 1 ½ days each session. Sessions included in the conference are motivational interviewing, teenage driving program and a lunch and learn on drug trends.
C. The Advanced Faculty Development is scheduled April 23-25, 2014, in the Pioneer Room at the State Capitol. Kathy Story will facilitate.
II. The subcommittee report from Chris Iverson, Judge Reich and Judge Anderson on court policies and rules review was tabled and moved to the March 2014 meeting.
III. Bench Book Updates
A. The Trial Court Bench Book has been delayed by Judge M. Richard Geiger due to medical leave. As soon as he returns, he will work on the changes and forward them to the State Court Administrator’s office.
B. The Municipal Court Bench Book was updated by Judge William Severin and distributed in October at the Municipal Judges Seminar.
C. The Domestic Violence Bench Book was updated by Robin Runge. She added Chapter 9 on
Ensuring Access to Safety for Underserved Victims. This will be printed and distributed in the near future.
D. Ms. Barnhardt will send the Magistrate Bench Book to Judge McCullough and Judge McClintock for their review and input.
I. Review/Update Strategic Plan for Judicial Branch Education - Ms. Barnhardt referred the Commission to the status section of the Strategic Plan. Changes include, specific training on Odyssey, ongoing online monthly sessions, continuation of Faculty Development, partnerships with SBAND, UND Law School, and continuation of Court Management Courses with South Dakota.
A 2013-2014 calendar of events has been sent out in October. The education web page needs to be updated to house information and electronic versions of conference materials.
All of the new judges are taking the online course offered by the National Judicial College which is a transition to the bench course. All new judges within the last year have taken the online course.
Regarding the training center goal, architects have toured and conducted a study on the need of more court space. Ms. Holewa talked with Ms. Barnhardt on her future staff needs to address technology and distance learning.
A. Special Guest SBAND Executive Director, Tony Weiler shared that SBAND will send a schedule of CLE’s to the court to strengthen relationships and communication between SBAND and the court system. To date, there are 14 events scheduled through 2014. Mr. Weiler will send the link to Ms. Barnhardt to distribute to the court system.
Since the Bench and Bar Seminar has been eliminated there have been requests from members of the Bar to interact with the court. Right now, SBAND is in the process of developing content for the annual meeting.
Judge McCullough suggested that a session on Odyssey would draw in members of the Bar.
Mr. Weiler explained it would be nice to have an interactive session. Mr. Zubke said in January he attended the Cass County Bar Association meeting and conducted a session on Odyssey. The feed back was not well received, as most of the lawyers thought their secretaries would benefit from it more.
Judge Anderson said she would like to see more social opportunity to meet and visit with more attorneys outside of the courtroom. Mr. Weiler stated this is something that goes beyond education and CLE. Ms. Barnhardt and Mr. Weiler will continue to work together on the content for the annual meeting.
B. Judge McCullough asked Mr. Zubke the status of updates on Odyssey. Mr. Zubke shared that the 2011 version was moved to 2012 in October. There are some problems that are affecting the system occasionally. The 2013 update is approaching a testing environment, which will allow electronic signatures easier than the previous version. This is more comprehensive in the ability to take notes and signing names. Mr. Zubke said that they are going to schedule some demonstrations of changes that will take affect in 2014. This will be more of a “Go To” feel and could be opened to judges.
II. A proposal to offer training on same-sex marriage laws was discussed. Ms. Barnhardt brought it to this Commission to see if it is worthy to add to the next Judicial Conference agenda or pass along the information to SBAND. The facilitator conducts a 90 minute breakout session. It is funded through the Williams Institute through UCLA and is covered under grant funds so wouldn’t require funding. After discussion, it was suggested that SBAND to take up the topic.
III. Judge Sonna Anderson has completed her final term with this Commission and her last meeting is December 6, 2013. Justice Maring is retiring as of December 30, 2013, and December 6, 2013 is her last meeting. New Commission members are, Judge Debbie Kleven and Justice Daniel Crothers. Dean Rand was reappointed to another 3 year term.

A motion was made by Judge Anderson to nominate Judge McCullough as Acting Chair of the Judicial Branch Education Commission. The motion was seconded by Judge Reich, motion carried.
