Justice Maring called the meeting to order. A motion was made by Judge McCullough to
approve the October 26, 2012, minutes. The motion was seconded by Judge Reich, motion
I. Conference Updates - Ms. Barnhardt updated the Commission on the progress of the following
A. The ICWA Conference is scheduled February 20-22, 2013, at the Seven Seas Hotel in
Mandan. This conference is co-sponsored by the Native American Training Institute and the ND
Supreme Court. Topics include: ICWA 101 with Judge William Thorne, Leave No Indian Child
Behind with Daryle Conquering Bear, Dakota 38 screening with Peter Lengkeek, Families,
Children & Trauma with Duane Gourneau, and several break out sessions on various topics.
B. The Clerk of Court Conference is scheduled May 1-3, 2013, at the Radisson Hotel in
Bismarck. Local faculty will be presenting on Odyssey, Self Defense, CJIS, Dealing with
Difficult People, Appellate Procedure, and a tour of the ND State Penitentiary.
C. The Judicial Institute is scheduled May 20-22, 2013, at the UND School of Law in Grand
Forks. Unfortunately, 2 speakers have cancelled, which has opened up 1.5 hours. After a brief
discussion, it was agreed that Judge McCullough would facilitate a session pertaining to Odyssey
to fill the vacant time on the first day. Ms. Barnhardt will find faculty to replace the session on
veteran’s issues on the second day.
D. The State Bar Association of North Dakota’s Annual Meeting is scheduled June 12-14, 2013,
at the Ramkota Hotel in Bismarck. The Judicial Conference will meet on June 13, 2013. Topics
will include: Legislative Update, Proposed Redistricting, and Citizen Access Coordinator
II. A motion was made by Judge Reich to approve the Final Draft of the 5-year Strategic
Plan for the Judicial Branch Education Commission. The motion was seconded by Cory
Pedersen, motion approved.
III. A motion was made by Judge McCullough and seconded by Judge Reich to add the
following language to the Judicial Branch Education Commission Course Approval Policy:
“Web-bases Courses - Live, inter-active courses presented over the internet or other media
source may be awarded continuing judicial education credit if sponsored by an organization that
is presumptively approved. Credit for other courses is subject to approval of the Judicial Branch
Education Commission.” Motion approved.
A motion was made by Judge McCullough and seconded by Judge Reich to add the
following section to the Course Approval Policy: “Application for Credit to Outside Entities-Court Administration staff will not seek continuing education credits from other entities for
individual employees unless the continuing education, certification, or license is required by the
individual’s position with the court system.” Motion approved.
A motion was made by Judge Reich and seconded by Judge McClintock to add the
following language to the Self-Study Policy under the Authority section: “recorded or on-demand
web-based courses or webinars” This gives the Commission authority to grant self-study
continuing education credit for online course work. Motion approved.
By consensus, the Commission agreed to change the outline numbers and letters to reflect the
changes in the Course Approval Policy.
I. Conference evaluations were discussed. The fall Judicial Conference was well received.
Suggested future topics include Odyssey training, Child Support, Mental Health issues, Westlaw
Refresher, and 4th Amendment issues.
The Municipal Judges Conference held in October had great attendance and evaluations came
back positive with several commenting that this was the best conference they have attended.
II. Judicial Referee on-line training has been scheduled starting Monday, March 4, 2013, at 3
p.m. for approximately 1 ½ hours. The topic for the first session is synthetic drugs.
III. The Commission has appointed Cory Pedersen to the CJE Approval sub-committee replacing
IV. The Commission has appointed a new sub-committee to review court policies and rules
related to judicial branch education. The members include Judge Reich and Chris Iverson. Lee
Ann Barnhardt will serve as staff for the sub-committee.
V. 2013-2014 Conference Planning
1. The Judicial Writing seminar is scheduled August 28-29, 2013, at the Radisson Hotel
in Bismarck. Ron Hofer will serve as faculty.
2. The Juvenile Court conference is scheduled September 11-13, 2013, at the Radisson
Hotel in Fargo.
3. The Municipal Court conference is scheduled October 7, 2013, at the Radisson Hotel
4. The Fall Judicial Conference is scheduled November 25-26, 2013, at the Radisson
Hotel in Bismarck. It was suggested to view past conference evaluations to determine what
topics were of interest.
5. The next Faculty Development is scheduled April 3-4, 2014, at the Capitol. Kathy
Story will be facilitating. This course will be developed as an advanced session for past
