Justice Maring called the meeting to order. A motion was made by Judge Reich to approve

A. The Judicial Institute is scheduled May 20-22, 2013, at the UND School of Law in Grand
Forks. Day 1 consists of Judge Janice Martin from Louisville, Kentucky, presenting on
Identifying and Responding to Elder Abuse, and Judge Steven McCullough from the East
Central Judicial District presenting on File and Serve: The Judicial Perspective and facilitating a
session on Odyssey Issues. Day 2 consists Stephen Cribari from the University of Minnesota
Law School presenting on Admitting Digital Evidence, and Professor Margaret Moore Jackson
from UND School of Law presenting on Changes in Fair Housing Laws. Day 3 consists of Brock
Hunter from Minneapolis, Minnesota, presenting on Echoes of War: The Combat Veteran in
Criminal Court, and Amy Gunkelman from the Fargo Veteran’s Association presenting on
Veterans and Post Traumatic Stress.
B. The SBAND annual meeting is scheduled June 12-14, 2013, at the Ramkota Hotel in
Bismarck. The Judicial Conference convenes on June 13, 2013. The Pattern Jury Commission
Annual Report will be provided for informational purposes only and the Committee on
Legislation Report and Session Update will be presented by Justice Dale Sandstrom and Jim
Ganje. The Judicial Planning Proposal will be presented by Justice Carol Ronning Kapsner and
the Citizen Access Coordinator Role and Responsibility will be discussed by Sally Holewa and
Justice Daniel Crothers.
C. The Traffic Safety Seminar is scheduled June 13, 2013, in Medora. Aaron Birst with the
Association of Counties is sponsoring the seminar focusing on CDL and truck issues.
D. The Judicial Writing Seminar is scheduled August 28-29, 2013, at the Radisson Hotel in
Bismarck. Ron Hofer will be the facilitator.
E. The 2013 Juvenile Court Conference is scheduled September 11-12, 2013, at the Holiday Inn
in Fargo. This conference will mainly focus on exploring juvenile differences and changes in the
II. Referee Online Training has started. The first online training pertained to synthetic drugs.
The second will be on protection order issues.
I. The Fall Judicial Conference is scheduled November 25-26, 2013, at the Radisson Hotel in
Bismarck. Topics discussed for completing the agenda include Odyssey training, child support
issues, mental health issues, Westlaw refresher, and 4th Amendment issues.
II. After brief discussion, it was determined that the municipal court clerks will continue to be
invited to the entire Clerk of Court Conference each year. Education staff will make a better
effort to communicate with the municipal clerks and judges regarding the educational tracks and
to continue offering sessions of specific interest to municipal clerks.
III. The members of the new sub-committee to review court policies and rules related to judicial
branch education are: Judge David Reich and Asst. Trial Court Administrator Chris Iverson. Lee
Ann Barnhardt will serve as staff for the sub-committee. After some direction on what the sub-committee should review, it was determined they will look at all policies and rules that could
impact judicial branch education, including budget guidelines regarding out of state travel for
judges and staff. The sub-committee will report back at the next commission meeting.
IV. Judge M. Richard Geiger will update the Trial Court Bench Book this fall. The Municipal
Court Bench Book will be updated by Judge William Severin. Ms. Barnhardt, Judge
McCullough, and Judge McClintock will look at making any changes to the Magistrates Bench
Book. Professor Robin Runge will be asked to review the Domestic Violence Bench Book and
make any changes necessary.
V. The 2014 Faculty Development Program is scheduled April 23-25, 2014, at the State Capitol.
Kathy Story will be facilitating. This course will be an advanced session for past participants.
