Justice Maring called the meeting to order. A motion was made by Judge McCullough to
approve the June 5, 2009, minutes. The motion was seconded by Deb Carlson. Motion carried.
Old Business I. Lee Ann Barnhardt updated the Commission on the progress of the following
conferences:
A. The Juvenile Court Conference is scheduled September 28-30, 2009, at the
Radisson Hotel in Fargo. A total of 49 participants have registered.
B. The Municipal Judges Seminar is scheduled on October 12, 2009, at the Seven
Seas in Mandan. Kathy Story of Memphis, TN will be facilitating this conference.
C. The Court Reporters Training is scheduled November 23-24, 2009, at the
Seven Seas in Mandan. Larry Paiz of Dallas, TX is the facilitator. They will be
working on Case CATalyst Version 10 training.
D. The Judicial Conference is scheduled November 23-24, 2009, at the Radisson
Hotel in Bismarck. The agenda will be presented to the Judicial Conference
Executive Committee for approval.
E. Protecting Yourself in the Courtroom training has been postponed. After
discussion on the need for this training it was approved by consensus to consider
offering this as a program with the State Bar Association at its annual meeting.
F. The Midwest Regional Drug Court Conference is scheduled October 14-16,
2009, at the Seven Seas in Mandan. Approximately 125 participants from North
Dakota and South Dakota have registered for this conference.
II. Bench Book Updates
Trial Court Bench Book - Judge M. Richard Geiger is updating the Trial Court
Bench Book. The new versions will be distributed to each District Court Judge.
Municipal Court Bench Book - Judge William Severin is updating the Municipal
Court BenchBook. Once this is complete, each Municipal Judge will receive a
paper and electronic version.
Domestic Violence Bench Book - Lee Ann Barnhardt has contacted Robin Runge,
ND School of Law and asked her to work on the Domestic Violence Bench Book.
Robin agreed to assist in the effort.
III. Status of Bench and Bar Seminar
Peter Welte, State's Attorney, Lee Ann Barnhardt, and Justice Maring met with
the CLE Committee of the State Bar Association to discuss suspending future
Bench and Bar Seminars due to a lack of participation. The CLE Committee voted
to recommend to the Board of Governors that future Bench and Bar Seminars be
suspended and that a joint program be considered for the State Bar Annual
Meeting. The Board of Governors was expected to consider the recommendation
at its September 19 meeting.
The Bench and Bar Seminar topic was tabled until the next Commission meeting
on December 4, 2009
New Business I. Enterprise Learning Management System
Lee Ann Barnhardt is on the Peoplesoft Platform team for the ELMS system. This
system will track education hours, conference registration, create courses, etc.
electronically using Peoplesoft. This will include on-site and off-site programs.
The program will "go live" in January. Lee Ann Barnhardt, Kim Dockter and
Lana Zimmerman will be attending training for the system in December..
II. New Judge Orientation - Demonstration
Kim Dockter was unavailable to give a demonstration at this meeting. However,
she will demonstrate the New Judge Orientation created on Shutterfly to this
Commission at the December meeting.
III. Leadership Institute in Judicial Education
Kathy Story of Memphis, TN will be the lead facilitator for this conference
scheduled March 30-April 1, 2010. A total of 30 participants have been invited to
participate. This conference will be held at the State Capitol, Bismarck.
IV. Expiring Terms of Commission Members
The terms for the following members of the Judicial Branch Education
Commission expire on January 1, 2010: Jean Lindvig, Judge Steve McCullough,
and Judge David Reich. All three commission members agreed to be reappointed
for another three year term. Their names will be submitted to the Executive
Committee of the Judicial Conference for approval.
V. For the Good of the Order - 2010 Commission meeting dates are as follows:
March 30, 2010 at 9:00 a.m. June 4, 2010 at 9:00 a.m. September 10, 2010 at 9:00 a.m. December 3, 2010 at 9:00 a.m.
