The meeting was called to order at 10:00 a.m. IT WAS MOVED BY BIRCH BURDICK, SECONDED BY JUDGE DEB KLEVEN, AND CARRIED UNANIMOUSLY THAT THE DECEMBER 2, 1999, MINUTES BE APPROVED.
Alyson Schmidt invited Deb Davis to review the draft of the Northeast Central Judicial Districts JDC accountability program. Deb began by stating that the program consists of four phases, totaling 12 months. In the orientation phase, drug court review hearings will be held once a week, the participant will have one or two probation contacts a week and a minimum of two UA tests will given. The UA tests will be both random and scheduled. Parents will be expected to attend review hearings, attend "True Colors," and participate in family therapy, if appropriate. The juvenile will be required to complete 20 hours of community service by the end of their time in JDC. School attendance is required unless ordered otherwise. Tracking and restitution will occur as ordered by the JDC judge. The JDC participants will also take part in educational classes such as basic drug and alcohol education, individual treatment as determined by treatment provider, and attend one support group a week. Deb stated that "team" meetings will occur every other week. Deb stated that the purpose of the team meeting is to touch base and indicate concerns regarding JDC participants. No decisions will be made. Committee members expressed some concern with meeting to discuss progress of the juveniles, when the juvenile is not present. It was decided that the JDC judge will decide whether to be present at the team meetings and the extent of his/her participation.
In the second phase, drug court review hearings will be held every week unless ordered otherwise, the participant will have one probation contact a week and a minimum of two UA tests will be given. The UA tests will be both random and scheduled. Parents will be expected to attend review hearings, and participate in family therapy, if appropriate. School attendance is required unless ordered otherwise. Tracking and restitution will occur as ordered by the JDC judge. The JDC participants will also take part in educational classes such as relapse and recovery, co-dependency, assertiveness, and health, individual treatment as determined by treatment provider, and attend one support group a week.
In the third phase, drug court review hearings will be held every other week unless ordered otherwise, the participant will have one probation contact a week and a minimum of one UA test will be given, unless ordered otherwise by JDC judge. The UA tests will be both random and scheduled. Parents will be expected to attend review hearings, and participate in family therapy, if appropriate. School attendance is required unless ordered otherwise. Tracking and restitution will occur as ordered by the JDC judge. The JDC participants may be required to take part in TaiChi classes, Tai Kwon Do, or ropes classes, individual treatment as determined by treatment provider and weekly support groups.
In the fourth phase, drug court review hearings will be held once a month unless ordered otherwise, the participant will have one probation contact every other week and UA tests will be given as ordered by JDC judge. The UA tests will be both random and scheduled. Parents will be still be expected to attend review hearings. School attendance is required unless ordered otherwise. Tracking and restitution will occur as ordered by the JDC judge. The JDC participants will also take part in a discharge group, individual treatment as determined by treatment provider and attend a weekly support group. The juvenile may also be asked to mentor another JDC participant. Upon successful completion of the accountability program, the juvenile will graduate.
Justice Maring invited Mary Hall to review the draft of the East Central Judicial District's JDC accountability program. Mary stated that the program consists of three phases, totaling 6 to 9 months. In the initial phase, drug court review hearings will be held once a week, the participant will have one or two probation contacts a week and a minimum of two UA tests will given. The UA tests will be both random and scheduled. Parents will be expected to attend review hearings, and participate in family therapy, if appropriate. The juvenile will be required to complete 20 hours of community service by the end of their time in JDC. School attendance is required unless ordered otherwise. Tracking and restitution will occur as ordered by the JDC judge. The JDC participants will also take part in educational classes as ordered by the JDC judge and individual treatment as determined by treatment provider. Mary stated that the JDC team will meet by conference call to discuss the participants.

Parents will be expected to attend review hearings when necessary. School attendance is required unless ordered otherwise. Tracking and restitution will occur as ordered by the JDC judge. The JDC participants will also take part in educational classes as ordered, individual treatment as determined by treatment provider and attend weekly support groups as ordered. Upon successful completion of the accountability program, the participant will graduate.
The committee discussed incentives for the juvenile to enter Juvenile Drug Court. Justice Maring noted that while attending the National Association of Drug Court Professionals Juvenile Drug Court Conference in Phoenix, AZ, she learned that a number of drug courts are expunging the participant's entire record. Birch Burdick agreed to consider this option and to find out the position of other States Attorneys. The committee will discuss this at the next meeting.
Justice Maring noted that the Fargo "team" will attend planning grant training on April 16 - 18, 2000, in Portland Oregon.
The next Juvenile Drug Court Planning meeting will be held February 11, 2000, at the Radisson from 10:00 - 1:00. With no further business the meeting was adjourned.
