A person is guilty of an offense if, without the consent of the law enforcement officer, the person willfully takes or removes, or attempts to take or remove, a firearm from a law enforcement officer engaged in the performance of official duties.

The State's burden of proof is satisfied if the evidence shows, beyond a reasonable doubt, the following essential elements:
1. On or about the ____ day of _______________, 19__, in ______________ County, North Dakota, the Defendant, _______________, willfully took or removed a firearm from a law enforcement officer.
2. The Defendant did not have the consent of the law enforcement officer.
3. The law enforcement officer was engaged in the performance of official duties.
