II. Whether an injured party was fully compensated under N. D. Cent. Code 32-03-09.1 where the measure of damages received did not place the injured party in the same financial position as before the injury.

A. Whether the trial court properly concluded there is no genuine issue of material fact as to damages.
B. Whether Sullivan received the full measure of damages to which he is entitled under N.D. Cent. Code 32-03-09.1.
