Appellant's Statement of the Issues: A. Whether the District Court erred in granting summary judgment in favor of the City of Bismarck as to the Appellants' negligence claim on the grounds that the City of Bismarck owed no duty to the Appellants. B. Whether the District Court erred in granting summary judgment in favor of Damian Dionne as to the Appellants' negligence claim on the grounds that Damian Dionne owed no duty to the Appellants. Appellee's Statement of the Issues: A. Summary Judgment was appropriate in this case. B. Bismarck had no duty to the Doans because it did not exercise control over the area where the Doans were allegedly injured and thus it cannot be held liable for their alleged injuries. 1. Bismarck did not have a nondelegable duty to guaranty the Doans' safety. 2. Bismarck had no duty to the Doans because it did not exercise control over the civic center at the time and place of the incident. C. Bismarck relied on an independent contractor to run the agri-international show and is not liable for the negligence, if any, of its independent contractor. Appellee's Statement of the Issues: Defendant/Appellee Damian Dionne presents the following issue for review: Whether the district court properly granted summary judgment in favor of Damian Dionne as to the Appellants' negligence claim on the grounds that Damian Dionne owed no duty to the Appellants. | |||||||||
