because it denies a respondent equal protection of the
law by not allowing for placement in the least
restrictive alternative form of treatment.
II. Whether the evidence was sufficient to sustain the
Order for Commitment.
Appellee's Statement of the Issues:
I. Whether the provisions of Chapter 25-03.3 of the North Dakota Century Code violate equal protection by omitting authority for a judicial order to less restrictive alternative, as is provided in Chapter 25-03.1.
II. Whether there was sufficient evidence to sustain the trial court's finding that the Respondent was a Sexually Dangerous Individual.
