1. When there exists no claim for personal injury, does a medical lien asserted under N.D.C.C. '35-18-01 attach to the tortfeasor=s liability coverage?
2. If a medical lien asserted under N.D.C.C. '35-18-01 attaches to the liability coverage, does the medical lien take priority over the wrongful death claim made by the surviving heirs or must the liability coverage be equitably allocated among all
claims made?
Appellee's Statement of the Issues:
I. Whether a hospital lien filed pursuant to N.D.C.C Chapter 35-18 for payment of medical services provided to patient as a result of injuries the patient received in an automobile accident attaches to the liability insurance policy of the
tort-feasor who is alleged to have negligently caused the injuries requiring the hospitalization of the patient at the time the medical services are provided thereby creating a priority over a Wrongful Death claim which has not been commenced and
did not exist until the death of the patient?
