I. The Trial Court Properly Dismissed Bender and Young's Complaint and Properly Ordered the Mechanic's Lien Stricken, Released and Satisfied
A. Bender and Young are not the Proper Persons Entitled to Claim a Mechanic's Lien Under North Dakota Century Code 35-27.
B. Bender and Young are Barred From Bringing Any Action Against Beverly Anne Premised Upon the Doctrine of Res Judicata and Collateral Estoppel.
II. The Trial Court Properly Voided the Quit Claim Deed Filed by Bender and Young on Real Estate Owned by Beverly Anne, Inc. Bender and Young Have No Right, Title or Interest in the Real Estate Sought to be Conveyed by the Quit Claim Deed.
III. The Trial Court Properly Awarded Attorney's Fees and Costs to Beverly Anne, Inc.
IV. Beverly Anne, Inc., is Entitled to an Award of Attorney's Fee for Defending This Frivolous Appeal Brought by Bender and Young.
